DPP takes over Kayihura case

The Director of Public Prosecutions has taken over a case in which the Inspector General of Police Gen. Kale Kayihura is accused of torture.

The Director of Public Prosecutions has taken over a case in which the Inspector General of Police Gen. Kale Kayihura is accused of torture.The move followed Justice Joseph Murangira of the High Court’s rejection of the DPP's request to hear matter ex parte. The DPP was objecting to the appearance of three lawyers- Abdallah Kiwanuka, Daniel Walyemera and Martin Muhumuza who are part of the group that was privately prosecuting  Kayihura.

The application sought to review a decision of Makindye magistrates court refusing him to automatically take over the prosecution of the IGP. 

Kiwanuka said that the constitution provides that the DPP is mandated to exercise this power in  regard to public interest.

The private lawyers who last week went to Makindye magistrates court to start the case against the IGG Kayihura said they had eventually agreed to work with the DPP.  The DPP’s representative  Senior Principle State Attorney Lino Anguzu told  Court that the law in criminal proceedings, allows only the DPP and the complainants who instituted the case to appear in court for review, but any other parties may join the case with court's permission.
