The Commissioner General of prisons Andrew Byabashaija has apologised to the Jinja Chief Magistrate, Francis Kaggwa, for failing to comply with his earlier court orders to transfer sickly and elderly suspects in the Kasese killings from Kirinya to Luzira prison.
Byabashaija's apology was carried to court by his assistants Natukunda Aliyo and James Kisambu, from the legal and health departments of prison respectively. The two explained to court that the earlier orders had never been served to the Commissioner General except the most recent one of February 20th 2017.
Natukunda and Kisambu further informed court that since the Commissioner General had already complied with the order to transfer the suspects to Luzira prison for purposes of accessing medical care, he needed not to appear before court as earlier summoned.
Meanwhile, court has heard that police is still investigating the offenses allegedly committed by the Rwenzururu king Charles Wesely Mumbere and his royal guards between March and November 2016, within Kasese region, which led to the deaths of over 100 people. The offenses include murder, terrorism, treason, robbery, attempted murder and malicious damage to property .
Presiding chief magistrate Francis Kaggwa has now adjourned the case to the 20th March for further mention.
In a related development , the Jinja High Court will on 14th March 2017 determine the bail application filed by the Rwenzururu kingdom prime minister Thembo Kitsumbire.
Justice Eva Luswata heard Kitsumbire's bail application on Monday morning in which he asked court to be temporarily released from Luzira prison.
Kitsumbire , through his lawyers of Alaka and company Advocates told court that he is of advanced age and suffers from various ailments which need special attention from home.
