Court asks DPP to formally apply to take over Kayihura case

Court was subsequently adjourned to 29th August to allow for the DPP to file a formal request to take over the case.

Makindye Magistrates Court has ordered the Director of Public Prosecution, Mike Chibita, to file a formal application if he wishes to take over the contentious criminal case against the IGP Kale Kayihura. 

The DPP had earlier sent a letter to the Makindye Magistrates court expressing his interest in taking over the case. The DPP had invoked article 120 of the constitution which mandates his office to take over any criminal proceedings instituted by any person in a court of law. 

Court was subsequently adjourned to 29th August to allow for the DPP to file a formal request to take over the case.

Meanwhile, Kayihura who was supposed to show up in the Makindye court on Wednesday morning did not show up and the court premises became a scene of confusion after his supporters threatened to beat up private lawyers who are prosecuting the case.

Kayihura and seven other senior officers are charged with offences in regard to torture after opposition leader Kizza Besigye were whipped on the day the former presidential candidate was granted bail by the High Court on July 17th.
