The Court of Appeal has thrown out NRM's Nathan Igeme Nabeta as Jinja East Constituency MP on grounds of falsification of election results.
Three justices including former deputy chief Justice Steven Kavuma, Richard Buteera and Paul Mugamba ordered the Electoral Commission organises fresh elections to fill the post that they have now declared vacant.
The justices also declined to declare Nabeta's political rival FDC's Paul Mwiru as MP, reasoning that they can not also be seen based on falsified results to determine the winner of an election.
In that regard, the justices partially faulted High court judge Lydia Mugambe for declaring Paul Mwiru as MP for Jinja East Constituency on 18th/July 2016.
In their ruling read to the court by Deputy registrar Taddeo Asiimwe, the justices concurred with Justice Mugambe that conducted the said election in non-compliance with the law from the time of opening the ballot boxes, transmission of results until at a time of declaring a winner.
Mwiru contested Nabeta's election on grounds that he connived with the EC to alter results at Danida A-D polling station which put him at an advantage in the said election.
Having been dissatisfied with the High court decision, Nabeta petitioned the court of Appeal which has, however, today upheld the lower court's decision.
The Court also ordered Nathan Nabeta and the electoral commision to pay costs to FDC's Paul Mwiru for both the Court of Appeal and in the High court.
