Jailed senior police officer Nixon Agasiirwe Karuhanga has petitioned the High court-civil division to challenge his trial before the General Court Martial on charges of kidnapping 3 Rwandan nationals.
Agasirwe wants express orders for his release from custody at Luzira prison on grounds that he is not a Military officer and therefore cannot be subjected to Military law.
He contends that the basis of his charges before the army court does not hold water as he cannot be blamed for illegally possessing a firearm yet given his vocation as a senior superintendent of police, he is licensed to hold one.
Agasirwe through his lawyers of Joel Olwenyi and company advocates argues that unless the High court intervenes, the army court will continue to violate his rights to a fair and speedy hearing having had his ruling on bail deferred on 2 different occasions yet prosecution keeps on bringing fresh charges.
The officer also accuses the army court of being biased and fears that substantive justice will not be served.
Agasirwe who is a former commandant of the special operations unit was in October 2017 charged and remanded to Luzira prison by the General Court-martial on charges of kidnapping 3 Rwandan nationals whom he allegedly deported back to Rwanda without their consent in 2015.
